Ok I get this is an Everquest emu but my question is how do you make an emulator of another game legally? I am just making sure that I don't start playing something that is kinda illegal.. stupid question? Possibly I just want someone to BRIEFLY explain to me(if possible) how making a free emu of another game is legal.

Well,
The player owns a copy of the client files. When you play on an emu style server, the server isn't transmitting the zone graphics, NPC graphics, zone layout, etc to the client. All they are doing is saying "you hit" or "you missed", and "your HP total is X".

But what about the client-server communication?

The server talks in a binary language the client understands. Transmitting data for the purposes of interoperability is a strongly protected right under most nation's intellectual monopoly laws.

See http://www.law.cornell.edu/copyright/commentary/chn95t1.htm
However, it held that decompilation of computer object code is a fair use privileged by the Act when there is no other way to gain access to the functional requirements for interoperability, which are not protected by copyright. n42 Writing for the court, Judge Reinhardt emphasized the uniquely opaque nature of computer programs that are distributed for public use in object code form, readable only by machine. n43 The court concluded that to deem Accolade's decompilation unfair would be to grant Sega a de facto monopoly over access to the Genesis III, although it held no patent on the console.

That raise your level of confidence?

The emu itself doesn't use any of the code that the Live servers use therefor they can't technically shut down the project. They have made it harder to gather live data with packet sniffers over the years though. Most Sony could do is kill your live account if they somehow linked a player here with one currently suscribing but getting the actual law involved...no chance. EULA =/= Law

to get banned for it on live you would have to literally petition for a GM, and then tell that GM directly that you play on an EQEmu server.. and even then its probably a low chance that you'll be talking to a GM who actually cares enough to pass the information along

are you kidding me? Live GMs don't ban hardly anyone for anything. After all, if they did, they'd only be losing your money! (Hence the reason that known and obvious exploiters, hackers, griefers, and scammers abound - or was it just that way on the Tribunal? =()

not to mention, the EULA...you know, the thing you click I ACCEPT to everytime you pull up the game. i dont know about you guys, my MY EULA doesnt say a thing about not playing a Emu server or HAVEING to pay for that matter. i click the accept button to justa few rules and regulations.

1.) You must have a glass of cold tea or hot coffe next to you.

2.) You must be ready to sit through long boreing hours of LOADING, PLEASE WAIT...

3.) You must fart at least once an hour in your chair, then bask in the ambience and inform others of said ambience with the invitation for them to bask in it as well.

and that my friends, is what i EULA states...at least until i PATCH ALL with SOD patcher and it will change it to SoD rules or set it back up with Sony rules...personally i like my EULA the way it is.

nothing really illegal on the client end. to my knowledge the only iffy thing is the patcher which sends the files to you (eqgame.exe) since it can be considered "warez" depending on the country it's being sent from. even in that scenario you wouldn't be liable so there's not much to worry about. and before someone mentions it can be reverse engineered (always seems to occur with this comment), well, that's illegal too.

good luck getting a gm now. I used to have petitions in the que for days at a time. I left my character on just to see if they would respond and nothing.

Let me guess... you submitted your petition in English, right? Should have used Hindi which is the native language of most of the GM staff on Live.
