Need a bit of help with online game history

Quick question... did the code for Meridian 59 get released to the fan base after the commercial game closed? Has that ever happened? Has there ever been an instance where player-run servers have been OK'd by a game company, other than like Neverwinter Nights? Any thoughts would be greatly appreciated as I'm doing some sekrit research on behalf of a friend.

Meridan 59 is back up actually.

The founders were Brian "Psychochild" Green and Rob "Q" Ellis II, game industry veterans that worked on Meridian 59 in the past. In the last part of 2001, NDS purchased all rights to the game from 3DO. The game was finally in the hands of people that understood and cared about the game.

The game was relaunched in March, 2002
 
Thanks, Eredhel. Actually, I'm trying to find out if there is any precedence for a game company releasing the code of a game that has gone offline to the fan base. The reason I'm asking is because there is a game company which I shall not name which is currently considering this.
